DMV wants to start texting-ban enforcement on July 1  - Politics - The Charleston Gazette - West Virginia News and Sports -: DMV wants to start texting-ban enforcement on July 1

CHARLESTON, W.Va. -- Although the law goes into effect Friday, the Division of Motor Vehicles is instructing law enforcement agencies to postpone enforcement of the state ban on texting while driving until July 1, when it becomes a primary offense under the new legislation, a DMV spokeswoman said Tuesday.
"If people want to stop texting and driving Friday, we certainly encourage that," said Natalie Harvey with the DMV.
While the law goes on the books Friday, texting while driving becomes a primary offense - meaning an officer can pull over a driver for the violation - on July 1. Also under the new law, using a hand-held cellphone becomes a secondary traffic offense on that date.

ONA, W.Va. -- Eighty cooks from 15 counties packed the Cabell Midland High School kitchen for healthy-cooking boot camp Tuesday and Wednesday.
"Superintendent [Jorea] Marple is absolutely serious about making West Virginia's school meals healthier," said Kristy Blower, a coordinator with the state Office of Child Nutrition. "We're training 80 more cooks in July, then we'll put on more workshops in the fall."
In many speeches this year, Marple has made it clear that, as she told the Gazette, "The schools have a role in fighting our state's obesity crisis, and research clearly tells us that well-nourished children do better in school."
Cabell County's veteran school cooks showed them how to make more nutritious tomato sauce by mixing five vegetables into it: onions, carrots, tomatoes and two kinds of squash.

Point Pleasant (WV) Register - Former school board member receives jail time: POINT PLEASANT — A former Mason County School Board Member received jail time on Friday after pleading guilty to one felony count of bribery.

Teresa Warner of Point Pleasant appeared before Circuit Court Judge Thomas C. Evans, III, who approved Warner’s plea agreement which dismissed five remaining counts of bribery. The bribery charge Warner pleaded guilty to was in relation to selling a GED test in exchange for money.

Prior to Evans’ sentencing, Warner’s Attorney Mike Shaw made a statement on her behalf, asking the court to take into consideration that though Warner has conceded she made a mistake, she also had a “wonderful career in teaching” and was active in the community. Shaw, as well as Evans, also discussed the court receiving several letters of support on Warner’s behalf from people in the community, including President of the Mason County Board of Education Dale Shobe. Shaw also wanted Evans to be aware of a letter of support which was also submitted on Warner’s behalf from Mason County School’s Superintendent Suzanne Dickens. The letters reflect that for many in the community, Warner remains a popular figure.

POINT PLEASANT — The bill to remove former Sheriff David L. Anthony from office has arrived and been paid by the Mason County Commission.

The county ended up paying around $10,000 to law firm Harris and Holmes out of Ripley which handled the commission’s request to begin removal procedures against Anthony. The county voted to begin this procedure in early January, shortly before Anthony was indicted by a grand jury on multiple counts. The saga to remove Anthony continued up until he agreed to a plea bargain in March and the commission agreed to stop the removal process.

This means for about two months of work, attorneys billed the county $10,000. Due to Anthony accepting a plea agreement, there is no way for the county to recoup those funds. Anthony’s sentencing on that plea agreement has been continued to May 21 in Mason County Circuit Court.

POINT PLEASANT — Former Sheriff David L. Anthony has been sentenced to 18 months in jail.

Anthony appeared before Judge David Nibert on Monday for his sentencing in Mason County Circuit Court which had been continued from earlier in the month. The continuance was granted when Anthony failed to provide the court with a written apology to residents and office holders in Mason County which he agreed to in his plea bargain.

At that hearing earlier this month, Anthony’s Attorney David Moye took responsibility for the apology not being available in writing, saying he had advised Anthony to verbally go on the record with the apology during the court proceedings as opposed to writing the apology.

Attorney Mike Clifford, who is representing the Plants family in a federal lawsuit against Moffett and the Mason County School Board, stated on behalf of the family that a protest and grievance has been filed against the DHHR. This suit is in response to a leaked investigative report from the DHHR claiming there was not sufficient evidence to convict Moffett of child abuse. The report surfaced on several media outlets out of Charleston and described Plants’ version of the incident, as well as the statements from the teachers who witnessed the alleged abuse and statements from Superintendent Suzanne Dickens. It was reported this report was not to be made public.

Judge reverses Mason deputy's termination West Virginia Record: Judge reverses Mason deputy's termination
12/21/2011 7:57 AM By Lawrence Smith -Mason Bureau

POINT PLEASANT - Finding that he was not afforded the opportunity of a pre-disciplinary hearing as required by state law, a judge has reversed a civil service panel's decision upholding the termination of a Mason County sheriff's deputy.

Judge Thomas C. Evans III ruled that the county Deputy Sheriff's Civil Service Commission erred in affirming Sheriff David Anthony II's decision firing Robert H. Glenn earlier this year. In his Dec. 8 order, Evans said the state Supreme Court made clear in a 2009 decision that prior to taking any disciplinary action, especially termination, against a deputy, the sheriff is duty bound to provide him or her a hearing prior to the case going before the Commission.

"The Court finds Appellant [Glenn] was denied his statutory right to notice of a pre-disciplinary hearing under W. Va. Code 7-14C-3," Evans said in his ruling.
